All too often, one of the many questions that I am asked from prospective or current clients is, how much is this going to cost me? As legal fees can be expensive, this is a fair question that every separating spouse wants answered.
The difficulty for family law lawyers is that we do not always have an exact answer to this question. While we do our best to provide estimates based on the current situation, there are many reasons that your legal fees may end up higher.
For example, something out of the ordinary happens, such as your spouse decides to move out of your matrimonial home unannounced, with your children, causing you to have to either commence an emergency motion or causing you to have to negotiate a temporary parenting schedule or the return of the children to the matrimonial home.
Another reason could be that your spouse may be difficult and uncooperative, for instance, refusing to provide the necessary financial documents to deal with your property and financial issues.
Your spouse could become difficult and not willing to compromise on a fair resolution of a parenting schedule. Further, your spouse may not want to pay you the proper amount of child support or spousal support that you are entitled to and to which he or she is obligated to pay, once this amount is determined.
These are only a limited number of reasons that your estimated legal fees may increase. While we do our best to keep your legal fees down, we need to ensure that we are protecting your legal rights and providing you with the support and assistance that you require to get to a fair resolution of your family matter.
